Welcome to Space Odyssey: Runner!

These Terms of Use ("Terms") govern your access to and use of Space Odyssey: Runner (the "Game"), developed and published under the name Plyhuskin Games ("we", "us", or "our").

By downloading, installing, accessing, or playing the Game, you agree to these Terms. If you do not agree, please discontinue use of the Game.

1. Eligibility

The Game is intended for players aged 13 and older.

If you are under the age of legal majority in your country or region, you should review these Terms with a parent or legal guardian and obtain their permission where required.

You must comply with applicable laws and the terms of your device's application store.

2. Game License

Plyhuskin Games grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the Game for personal, non-commercial entertainment, subject to these Terms and applicable law.

The Game is licensed, not sold.

All rights not expressly granted remain with Plyhuskin Games or the respective rights holders.

For downloads through Apple's App Store, Apple's Standard End User License Agreement (EULA) may also apply, as determined by the applicable App Store terms and any custom EULA provided for the Game.

3. Gameplay and Virtual Content

Space Odyssey: Runner is a space arcade game featuring missions, challenges, spacecraft, upgrades, achievements, and virtual rewards.

The Game may include virtual currency, experience points, energy or fuel, equipment, spacecraft skins, upgrades, and other digital items.

Virtual items:

Exist only within the Game.
Have no real-world monetary value.
Cannot be exchanged for real money.
Cannot be transferred or sold outside the Game unless expressly permitted.
May be subject to gameplay rules, balancing adjustments, and technical limitations.

We may adjust gameplay mechanics, progression systems, rewards, and virtual item characteristics to maintain gameplay balance and improve the Game.

Any changes will remain subject to applicable consumer protection laws.

4. In-App Purchases

The Game is free to download and may offer optional in-app purchases.

Purchases may include virtual currency, premium spacecraft, advertisement removal, unlimited fuel, and other digital content or features.

All payments are processed by the applicable platform, such as Google Play or Apple's App Store.

By making a purchase, you also agree to the relevant platform's payment terms.

Prices and availability may vary by country, currency, and platform.

Refunds are handled according to the applicable store's refund policies and mandatory consumer rights.

Restorable purchases may be restored through the Game or relevant platform services where supported.

Purchased digital content is provided for use within the Game and does not grant ownership of the Game's underlying intellectual property.

5. Advertising and Optional Rewards

The Game may display advertisements, including rewarded advertisements and interstitial advertisements.

Rewarded advertisements are optional and may provide in-game benefits after successful completion of the required viewing conditions.

Advertisement availability depends on factors including internet connectivity, geographic region, privacy preferences, advertising inventory, and third-party services.

We do not guarantee that advertisements will always be available.

Certain rewards may be subject to cooldowns, daily limits, or other gameplay restrictions.

Advertising services may process data in accordance with our Privacy Policy and applicable privacy regulations.

The Game may store progress, achievements, virtual currency, settings, and other gameplay information locally on your device.

Some features may interact with Google Play Games Services or Apple Game Center.

We recommend maintaining appropriate device backups where available.

We cannot guarantee recovery of locally stored progress after device loss, application deletion, data corruption, or unsupported transfers.

Nothing in this section limits rights or remedies available under applicable law.

7. Leaderboards and Achievements

The Game may offer leaderboards, achievements, and related platform gaming features.

Participation in certain online features may require an eligible Google Play Games or Apple Game Center account.

Players must not manipulate scores, exploit vulnerabilities, submit fraudulent results, or interfere with competitive integrity.

Where technically feasible and permitted by applicable law and platform rules, we may remove invalid leaderboard results or restrict abusive access to online features.

8. Acceptable Use

You agree not to:

Use cheats, unauthorized modifications, or exploits to gain unfair advantages.
Interfere with the Game's normal operation or security.
Attempt unauthorized access to game services or other users' information.
Distribute malicious software through interactions with the Game.
Commercially redistribute the Game or its assets without permission.
Violate applicable laws, intellectual property rights, or platform policies.

Nothing in these Terms restricts activities that cannot lawfully be prohibited, including rights provided by mandatory consumer protection or software laws.

9. Intellectual Property

The Game, including its software, visual design, artwork, characters, spacecraft designs, music, sound effects, interfaces, and branding, is protected by applicable intellectual property laws.

Relevant materials belong to Plyhuskin Games or their respective licensors.

You may not reproduce, commercially distribute, or create unauthorized derivative works from protected Game content, except where permitted by applicable law or an applicable license.

Third-party assets and technologies remain subject to their respective licenses.

10. Updates and Service Availability

We may release updates to improve stability, introduce content, adjust gameplay balance, fix bugs, or maintain compatibility.

Certain features may require an internet connection or availability of third-party services.

We may modify, temporarily suspend, or discontinue features where reasonably necessary, subject to applicable law.

We do not guarantee uninterrupted availability of online services or advertisements.

11. Privacy

Your privacy is important to us.

Information about data collection, advertising, privacy preferences, and third-party services is provided in our Privacy Policy.

By using the Game, you acknowledge that you have been provided access to this Privacy Policy. Any processing that legally requires consent remains subject to the relevant consent requirements.

12. Third-Party Services

The Game may use services provided by Google, Apple, and other technology providers.

These may include:

Google AdMob.
Google Play Games Services.
Google Play Billing.
Apple Game Center.
Apple App Store In-App Purchases.

Your use of these services may also be governed by their respective terms and privacy policies.

Plyhuskin Games is not responsible for independently operated third-party services beyond responsibilities imposed by applicable law.

13. Disclaimer of Warranties

The Game is provided on an "as available" basis.

To the maximum extent permitted by applicable law, we disclaim warranties not expressly required by law, including implied warranties of merchantability, fitness for a particular purpose, and uninterrupted availability.

We make reasonable efforts to maintain the Game's functionality and stability, but software errors or temporary service interruptions may occur.

Nothing in these Terms excludes statutory warranties or consumer rights that cannot legally be waived.

14. Limitation of Liability

To the extent permitted by applicable law, Plyhuskin Games shall not be liable for indirect, incidental, special, or consequential losses arising from use of the Game.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, intentional misconduct, or other legally protected claims.

15. Changes to These Terms

We may update these Terms to reflect changes in the Game, its services, or legal requirements.

Updated Terms will be published on this page with a revised "Last updated" date.

Where required by law, we will provide additional notice or request renewed acceptance.

Continued use of the Game after updated Terms become effective may constitute acceptance where permitted by applicable law.

16. Governing Law

These Terms are governed by applicable laws of Ukraine, subject to mandatory consumer protection laws and other legal rights applicable in your country or region.

Nothing in these Terms limits rights that cannot be waived under applicable law.
